Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and CandidReel Pty Ltd ("CandidReel", "we", "us", "our"), an Australian company, governing your use of the CandidReel platform at candidreel.com and any associated services.

1. Service description

CandidReel is a video interview platform that enables organisations to create, send, and review one-way and live video interviews. The platform includes AI-powered transcription, scoring, candidate pipeline management, and team collaboration features.

We may update, modify, or discontinue features of the platform at any time. We will provide reasonable notice for material changes that affect your use of the service.

2. Account responsibilities

To use CandidReel, you must create an account with a valid email address. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activity that occurs under your account
• Ensuring that the information you provide is accurate and up-to-date
• Notifying us immediately if you suspect unauthorised access to your account

If you create an account on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

3. Acceptable use

You agree to use CandidReel only for lawful purposes related to recruitment and hiring. You may not:

• Use interview recordings to harass, intimidate, or discriminate against candidates
• Share interview recordings publicly or outside your organisation without the candidate's consent
• Upload or transmit content that is illegal, harmful, or violates the rights of others
• Attempt to access another user's account or data without authorisation
• Use the platform to distribute malware, spam, or other harmful content
• Reverse engineer, decompile, or attempt to extract the source code of the platform
• Use automated tools to scrape, crawl, or extract data from the platform without our written permission

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice depending on the severity of the violation.

4. Intellectual property

Your content. You retain ownership of all content you create or upload to CandidReel, including interview questions, recordings, notes, and evaluations. By using the platform, you grant us a limited licence to store, process, and display your content solely to provide the service.

Candidate content. Interview recordings created by candidates are owned by the hiring organisation that created the interview. Candidates grant consent for their recordings to be used in the hiring process when they begin an interview.

Our platform. CandidReel and its underlying technology, design, branding, and documentation are owned by CandidReel Pty Ltd. Nothing in these Terms grants you any rights to our intellectual property beyond the limited right to use the platform as described here.

5. Subscription and billing

CandidReel offers a free plan with limited features and paid subscription plans with additional capabilities. Details of available plans and pricing are displayed on our pricing page.

Payment

Paid subscriptions are billed in advance on a monthly or annual basis. Payments are processed by Stripe. All fees are quoted in US dollars unless otherwise stated and are exclusive of applicable taxes.

Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date. We do not provide pro-rata refunds for unused portions of a billing period.

Price changes

We may change our pricing from time to time. We will provide at least 30 days' notice before any price increase takes effect. If you do not agree to the new pricing, you may cancel your subscription before the change applies.

6. Data and privacy

Your use of CandidReel is also governed by our Privacy Policy, which describes how we collect, use, and protect personal information. By using CandidReel, you acknowledge that you have read and understood our Privacy Policy.

If you use CandidReel to process personal data of candidates or other individuals, you are responsible for ensuring that you have a lawful basis for processing that data and that you comply with applicable data protection laws.

7. Limitation of liability

To the maximum extent permitted by law, CandidReel is provided "as is" and "as available" without warranties of any kind, either express or implied.

We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components. We are not responsible for any hiring decisions made based on information provided through the platform, including AI-generated scores and transcriptions.

To the maximum extent permitted by Australian law, our total liability for any claims arising from or related to your use of CandidReel is limited to the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, consequential, or punitive damages.

8. Termination

You may close your account at any time by contacting us at hello@candidreel.com or through your account settings.

We may suspend or terminate your account if you breach these Terms, if your account is inactive for an extended period, or if we are required to do so by law. We will provide notice and an opportunity to export your data where reasonably practicable.

Upon termination, your right to use the platform ceases immediately. We will delete your data in accordance with our Privacy Policy.

9. Indemnification

You agree to indemnify and hold CandidReel harmless from any claims, damages, or expenses arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

10. Governing law

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of CandidReel will be subject to the exclusive jurisdiction of the courts of Australia.

11. Changes to these terms

We may update these Terms from time to time. When we make material changes, we will notify you by email or by posting a notice on the platform at least 30 days before the changes take effect. Your continued use of CandidReel after the updated Terms take effect constitutes your acceptance of the changes.
